Terms of purchase

In order to bid on KJ Agro KFT, you must agree to our terms and conditions of purchase. The terms and conditions describe the buyer’s rights and obligations related to purchases on kjagro.eu. It is a condition of registration that you have read, understood and approved the agreement prior to bidding. Upon registration, you agree to the conditions of this agreement.

1. Introduction

These Terms & Conditions of Purchase (“Terms”) govern participation in auctions conducted on kjagro.eu, owned and operated by KJ Agro KFT (hereinafter referred to as “KJ-Agro,” “we,” “us,” or “our”).

By registering and placing bids on our website, you (“the Buyer”) agree to be bound by these Terms, which define your rights and obligations regarding purchases and participation in auctions organized or mediated by KJ Agro KFT.

Registration as a bidder constitutes acknowledgment that you have read, understood, and accepted these Terms in full.

2. Role of KJ Agro KFT

KJ Agro KFT acts as an intermediary and escrow service provider between sellers and buyers.
KJ Agro KFT does not own the objects listed on the website and acts solely on behalf of private sellers, companies, or institutions (“the Sellers”).

KJ Agro KFT’s role is to facilitate the sale process, handle buyer payments, and ensure transparent and secure transfer of ownership once the payment is confirmed and both parties meet all conditions.

KJ Agro KFT does not act as exporter, importer, or declarant in customs matters unless otherwise stated in writing.

3. Auction Procedure

All items listed on kjagro.eu are sold either through online auction or via a direct “Buy Now” option at a fixed price, when available.

Bidding is open around the clock and closes at a scheduled time for each listing.
If a bid is placed within three (3) minutes prior to the closing time, the auction will automatically be extended by three (3) additional minutes to ensure fair competition.

All items are verified and inspected by our technical team before listing to ensure authenticity and proper condition.
Each item sold through KJ Agro KFT is accompanied by a 30-day limited warranty, covering major mechanical or functional defects not disclosed at the time of sale.

KJ Agro KFT accepts no liability for:

  • technical failures, connection issues, or software errors,
  • bids not being registered,
  • or inability to access the website or contact the bidder or seller.

Once the auction closes or a Buy Now purchase is made, the highest bidder or direct buyer will receive a confirmation and invoice by email within 24 hours.
The issuance of the invoice is considered established contact between KJ Agro KFT and the Buyer.

4. Buyer Registration

To participate in any auction or make a direct purchase on kjagro.eu, all buyers must first have a verified buyer account created and approved by KJ Agro KFT.

Buyer registration is available to:

  • Hungarian and foreign companies, or
  • private individuals aged 18 or above.

At KJ Agro KFT, buyer registration is personally handled by our team to ensure authenticity and prevent fraud.

Registering under a false name or on behalf of another person or entity without authorization may result in permanent suspension and legal consequences under Hungarian law.

By requesting registration, you consent to the processing of your personal data in accordance with EU Regulation (GDPR) 2016/679 and Hungarian Data Protection Law for verification and communication purposes.

If KJ Agro KFT suspects misuse of an account, non-compliance with these Terms, or any irregular activity, we reserve the right to suspend, block, or permanently ban the buyer from further participation.

KJ Agro KFT also reserves the right to reject any bidder or cancel a sale without prior notice or justification.

5. Payment Terms

The winning bidder (Buyer) must complete the full payment within twenty-four (24) hours from the time the auction result is confirmed and the invoice issued.

For purchases made through the “Buy Now” option, the same 24-hour payment deadline applies from the time the buyer receives the invoice confirmation by email.

All payments must be made directly to KJ Agro KFT’s official bank account, as stated on the invoice.
Payments sent directly to sellers or any third party are not considered valid until confirmed and approved by KJ Agro KFT.

Failure to complete payment within the required 24-hour period entitles KJ Agro KFT to:

  • cancel the transaction,
  • re-list or re-auction the item, and
  • apply the relevant provisions under the Hungarian Civil Code (Act V of 2013), including the right to claim damages, loss of profit, and administrative expenses.

KJ Agro KFT may retain any deposit or partial payment as compensation for losses resulting from the buyer’s failure to meet payment obligations or any other breach of these Terms.

6. Delivery, Collection & Escrow Process

KJ Agro KFT operates as an escrow intermediary between the seller and buyer.
The transfer of ownership occurs only after KJ Agro KFT confirms receipt of full payment and the transaction is validated.

Collection or delivery of purchased items must occur within 29 calendar days from payment confirmation, unless otherwise agreed in writing by all parties.

KJ Agro KFT  may assist in arranging transport or export services on request, but such services are separate from the auction process and may involve additional costs.

KJ Agro KFT does not assume liability for transport delays, damages in transit, or customs clearance procedures.

7. Seller Responsibility

All objects are sold on behalf of the Seller, who remains fully responsible for the accuracy of the description, condition, documentation, and ownership of each item.

KJ Agro KFT acts solely as an intermediary and cannot guarantee or warrant the physical or mechanical condition of any item beyond the information provided by the Seller.

However, all items are verified and inspected by our technical team prior to listing to ensure that the description and condition correspond to the real state of the item at the time of publication. This verification process aims to ensure transparency and reliability for all buyers.

Buyers are strongly encouraged to request additional photos, videos, or technical information before placing a bid or purchase.

Once a bid is placed, it is legally binding under Hungarian law and cannot be withdrawn without the written approval of KJ Agro KFT.

8. Buyer Responsibility

By placing a bid, the Buyer agrees to purchase the item at the final winning bid price and to comply fully with all payment and collection obligations.

If the Buyer wins an auction or purchases an item through the “Buy Now” option, the Buyer is legally obligated under Hungarian and EU commercial law to complete the payment within forty-eight (48) hours after receiving the invoice issued by KJ Agro KFT.

Failure to make payment or arrange collection within the prescribed time allows KJ Agro KFT to:

  • take legal action under Hungarian jurisdiction,
  • claim compensation for financial losses, storage fees, or administrative costs, and
  • suspend or block the Buyer’s account from future participation.

All purchases made through kjagro.eu are considered Business-to-Business (B2B) transactions unless explicitly stated otherwise.
Private individuals may participate only when specifically permitted in the listing description or approved in writing by KJ Agro KFT.

9. Collection of Products

Following the conclusion of an auction or a Buy Now purchase, the Buyer has 15 calendar days from the date of payment confirmation to collect the purchased item, unless otherwise stated in the specific listing.

Certain items may have different collection terms, which will supersede the general conditions stated herein.

Before any collection can take place, the invoice must be fully paid and confirmed by KJ Agro KFT.
Once payment has been received and verified, the Buyer will receive a Collection Authorization Document (collection receipt) by email.
This document will include the seller’s contact details, enabling the Buyer to directly coordinate a suitable collection appointment.

Unless explicitly stated otherwise, the Buyer is fully responsible for:

  • collecting the purchased item,
  • providing proper transport, loading, and unloading equipment, and
  • dismantling the item if required.

If the Buyer fails to collect the item within the prescribed 15-day periodKJ Agro KFT reserves the right to take one or more of the following actions:

  1. Transfer to a Storage Facility:
    The item may be moved to an KJ Agro KFT–designated warehouse or partner location.
    All transfer, handling, and storage costs will be borne by the Buyer.
    Items will be released only after full settlement of these additional costs.
  2. Storage Fees:
    A storage fee of EUR 50 (excluding VAT) per week commenced per item will apply after the initial 15 days have expired.
  3. Re-auction or Disposal:
    If the Buyer fails to collect the item within 30 days after payment confirmation, KJ Agro KFTreserves the right to dispose of or re-auction the item.
    Any resale proceeds will be used to cover administrative and storage costs.
    The Buyer will not be entitled to any refund or compensation if the resale amount does not exceed the initial purchase price.

If the Seller is unable to facilitate collection within the agreed period, the Buyer may request rescheduling or termination of the agreement.
In case of termination, KJ Agro KFT will refund the amount paid, provided the delay was not caused by the Buyer or circumstances beyond reasonable control (e.g. customs delays, transport restrictions, or force majeure).

Neither KJ Agro KFT nor the Seller assumes responsibility for any deterioration, damage, or loss to the item caused by delayed collection, improper loading, or transport arranged by the Buyer.

Buyers acknowledge that many items are sold at attractive prices due to potential logistical, transport, or storage costs for the Sellers.
Consequently, the Buyer accepts that in certain cases, transport or disposal expenses may exceed the purchase price, and by placing a bid or completing a purchase, the Buyer fully agrees to these conditions.

10. EU Sales and Export

KJ Agro KFT operates in accordance with Hungarian and EU VAT legislation regarding the sale and export of machinery and equipment within and outside the European Union.

10.1. EU Sales

If you are a foreign buyer located within the European Union, you must provide a valid company VAT number prior to or immediately after purchase.
Only companies registered for intra-EU trade (VIES-valid VAT numbers) are eligible to purchase items without Hungarian VAT under the intra-Community supply exemption.

All invoices will initially include Hungarian VAT (27%), unless your VAT number is validated before the invoice is issued.
If you provide a valid VAT number after payment and export is proven, KJ Agro KFT will refund the VAT to the same IBAN from which the payment was made.

To obtain the VAT refund, you must submit all required export or transport documentation to:

no later than 30 days after payment confirmation.

VAT refunds are processed monthly, during the following calendar month after proper documentation has been received and verified.
Failure to submit the required documents within the deadline may result in loss of the right to VAT refund.

Required documents for intra-EU sales:

  1. Signed Buyer Statement issued by KJ Agro KFT confirming delivery outside Hungary.
  2. CMR Transport Document, signed and stamped by both sender and recipient (if transport is arranged by a freight company).
  3. Copy of the Buyer’s VAT certificate (showing the EU VAT number).
  4. The Buyer’s IBAN and SWIFT/BIC details used for the original payment.

VAT refunds are always transferred only to the same bank account used for the original purchase.
Requests to transfer VAT refunds to a different account may be refused or subject to additional verification, including written confirmation from the receiving financial institution that the account belongs to the same legal entity or individual.


10.2. Export Outside the European Union (Non-EU Buyers)

If you are a buyer located outside the EU, you are obligated to export the purchased item from the European Union.
Upon request, you must present official export documentation confirming that the item has physically left the EU customs territory.

To qualify for VAT-free export, the buyer must provide the following documents to KJ Agro KFT within 30 days after payment confirmation:

Required documents for exports outside the EU:

  1. Official Customs Export Declaration (EX-1) or equivalent document stamped by customs authorities.
  2. Copy of Bill of Lading, Air Waybill, or CMR document showing delivery to the destination country.
  3. The Buyer’s IBAN and SWIFT/BIC details used for the original payment.

Failure to provide complete export documentation within the prescribed period may result in the sale being treated as a domestic sale, and VAT will not be refunded.

All VAT refunds, once approved, will be transferred exclusively to the same IBAN account from which the purchase payment was made.


10.3. Additional Notes

  • Private individuals, regardless of residence, are not eligible for VAT-free purchases or refunds.

  • KJ Agro KFT reserves the right to refuse VAT exemption or refund in cases of incomplete or falsified export documentation.

  • KJ Agro KFT does not act as exporter or customs declarant on behalf of the buyer unless otherwise agreed in writing.

  • Buyers must ensure full compliance with all applicable Hungarian and EU customs regulations regarding export procedures.


11. Limitation of Liability

KJ Agro KFT shall not be liable for:

  • any indirect, consequential, or incidental damages;
  • any loss of profit, time, or data;
  • or any technical malfunction, downtime, or website error.

KJ Agro KFT’s total liability in any transaction shall never exceed the commission or service fee received for that particular auction.

12. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Hungary and applicable EU legislation.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary.

13. Amendments

KJ Agro KFT reserves the right to amend or update these Terms at any time.
Any modifications take effect immediately upon publication on kjagro.eu.
Buyers are responsible for reviewing the Terms before participating in each auction.

14. Warranty

All items sold through KJ Agro KFTare verified and tested by our technical team before being listed for sale.
Each object comes with a 30-day limited warranty offered directly by KJ Agro KFT.

This warranty covers major mechanical or functional defects that were not disclosed or visible at the time of sale.
If such a defect is discovered within 30 days from the date of delivery or collection, the Buyer must notify KJ Agro KFT in writing with supporting photo or video evidence.

KJ Agro KFT will, at its discretion:

  • assist in repair,
  • offer a replacement item of similar value, or
  • provide a partial refund, depending on the nature of the defect.

The warranty does not cover:

  • normal wear and tear,
  • consumable parts (e.g. filters, belts, tires, oils, batteries),
  • damage caused by misuse, neglect, incorrect operation, or transport,
  • and electrical or hydraulic components affected by external causes.

After the 30-day period, all responsibility for maintenance and repair passes to the Buyer.
